Warranty Disclaimer: All materials and products installed and inspected by ECS are provided “as is”, and without warranties of any kind, whether express or implied. All products purchased have been manufactured by other parties. These products may be under warranty by their respective manufacturers against defects in workmanship (or materials) that arise during its intended use. There may be a term limit to any of these manufacturers’ warranties, and these warranties may be invalidated by any misuse of the products. The manufacturers have provided all statistical information provided on this website. These statistics are reproduced solely for the Buyer’s information and convenience. Determining the adequacy of any product for any intended purpose is the sole responsibility of the Buyer. In making that determination, the buyer has not relied upon any warranty or representation made by our company. We do not recognize the authority of any agent, employee or representative of our company to bind us to any representation, affirmation of fact or warranty, expressed or implied. No warranty shall be created by any statement made for the advertisement or promotion of any product. ECS makes no warranties of any kind. Any and all warranties, expressed or implied, including warranties of merchantability for a particular purpose, are hereby disclaimed by our company. Any claim for consequential or incidental damages arising out of or connected to the manufacture, sale, delivery or use of any product found shall in no event be our company’s liability. In all events, our liability shall be limited to and shall not exceed the purchase price paid for the products by the Buyer. ECS shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if ECS has been advised of the possibility or consequential damage. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damage, so the above limitation or exclusion may not apply to you.*
Product Suitability: ECS cannot guarantee compliance with important individual laws, regulations governing sales, codes, construction or installation regulations, etc., for all the various localities that we service. ECS cannot be held responsible for the use or installation of products purchased from ECS. The purchasing party assumes responsibility for compliance with all applicable laws, regulations, and standards in the states to which the goods will be shipped, sold, and used. Please review the product application and local codes, laws, and regulations before purchasing a product from ECS to be sure that the product, installation, and use will comply with local laws. The purchasing party is responsible for applying for and obtaining any permits and inspections required for the installation and/or use of products at their own expense. Any recommendations made by ECS concerning compliance, use, design, installation, or operation of the products cannot be construed as representations or warranties, expressed or implied, and shall not impose any liability upon ECS**.
Exclusion of Consequential Damages: ECS cannot be held responsible or liable for penalties (including administrative penalties), special or punitive damages for lost profits or revenues, loss or damage from use of products to any associated equipment, cost of capital, facilities, property or services, bodily or emotional injury or loss of life, downtime, shut-down or slowdown costs, spoilage of material, or for any other types of economic loss not herein described arising from the use of a product sold to the purchasing party by ECS.
